New Delhi divorce takes 14 years

After 14 years of living apart a supreme court in New Delhi has dissolved the marriage of the couple saying “dead for all practical purposes” it would amount to cruelty to insist on its continuance.

The estranged couple Satish and Ganga Sitole, who also have a 15 year old boy, had lived apart for the past 14 years. They had filed cases against each other for cruelty and dowry harassment that failed to stand in court. The couple married in 1992, and Ganga moved out to live with her parents in 1994.

Satish filed for divorce in an andore court in 1998 on the grounds of cruelty and desertion.

The court did not grant the divorce, but passed a decree of judicial separation. So the couple could file for divorce if they continued living apart for another 2 years.

In 2003 the husband and his family were acquitted, Ganga agreed at the trial to return home to her husband but she did not.

The high court reversed the judgment and decree at the time of appeal, and ruled that the husbands conduct compelled Ganga to leave him.

The apex court said that the marriage shall stand dissolved, subject to Satish paying to the Ganga Rs 2 lakh by way of permanent alimony.
