Surrogate Japanese baby left homeless through Indian Law

A couple who went to Ahmedabad, India, to use the services of a sarrogate mother are now in a legal custody battle as the Japanese couple divorced whilst the surrogate mother was still pregnant.

Once the baby was born, Ahmedabad was under fire from serial bombings and the baby had to be taken to Jaipur, and has been looked after by the Arya Hospital.

The father wanted to take custody of the baby but his visa expired and he had to go back home to Japan, the child is being looked after well in the hospital but the baby’s future is uncertain.

Dr Yamanda who is the childs father came to take custody of his baby after his divorce in June, but Indian law prohibits a single father adopting a girl child. This had lead to several legal complications. The other major legal issue is when the father only has 50 percent DNA at what point do they take the DNA as a natural father.

Sarrogate pregnancies are growing fast in india but the births have not been regulated properly. The Surrogacy bill is pending in parliament, but the difficulting will be when the father wants to adopt his daughter as indian adoption law will not allow a single man to adopt a girl.
